本規約は、合同会社Octa Air（以下「当方」）が提供するアプリケーション「Octa Share」（以下「本アプリ」）およびその共有リンクを開くウェブページ（以下あわせて「本サービス」）の利用条件を定めるものです。本サービスを利用された時点で、本規約に同意いただいたものとします。ただし、表示名その他の利用者作成コンテンツを他の利用者へ送る機能については、下記 §6-1 の画面でその時点の版を明示的に確認・同意するまで利用できません。
提供者は 合同会社Octa Air、連絡先は support@octa-air.co.jp です。本規約および本サービスに関するお問い合わせは、このアドレス宛にお願いします。
本サービスは、待ち合わせや迎えのために期限つきで現在地を共有するためのものです。共有リンクと、必要に応じてPINを渡した相手だけが、期限が来るまでの間、地図上で位置を確認できます。あわせて、待ち合わせ場所のピン、Bluetoothによる「近くにいるか」の判定、都道府県などの粒度でのざっくり共有といった機能を提供します。
本サービスは、人の所在を継続的に把握するための見守り・監視サービスではありません。共有は必ず有効期限を持ち、期限が来れば自動的に停止します。
本アプリは、初回起動時に匿名のアカウントを自動的に発行します。氏名やメールアドレスの登録は不要です。Android 版では Google アカウントの連携は任意で、機種変更や再インストール後に友だちリストを引き継ぐためのものです。iOS 版は第三者ログインを提供しません。
端末およびアカウントの管理は利用者の責任で行ってください。端末を他人に渡した場合、その人は利用者として本サービスを操作できます。
本サービスの利用にあたり、次の行為を禁止します。
これらに該当する利用を確認した場合、当方は事前の通知なく当該アカウントの利用を停止し、または共有を削除することがあります。
初回公開版はすべての機能を無料で提供し、購入画面やアプリ内購入はありません。将来、有料プラン「Octa Share Pro」を提供する場合に限り、以下の条件が適用されます。その場合の無料範囲、上限、価格は購入画面に表示する内容が最新です。
本アプリを App Store から入手した場合、Apple の定める規約（Apple Media Services 利用規約およびそのエンドユーザ使用許諾契約に関する定め）が、Google Play から入手した場合は Google Play の利用規約が、あわせて適用されます。本規約は当方と利用者との間の契約であり、Apple および Google は本サービスの提供者ではなく、本サービスに関する保証および対応の責任を負いません。本規約とストアの規約が抵触する場合、当該ストアが要求する条件が優先します。
当方は、本サービスの内容を変更し、または保守・障害対応のために一時的に中断することがあります。本サービスの全部または一部を終了する場合は、可能な限り事前にアプリ内またはウェブでお知らせします。有料プランの提供を終了する場合の未経過期間の取扱いは、各ストアの規定に従います。
本アプリおよび本サービスに関する著作権その他の知的財産権は、当方または正当な権利者に帰属します。本規約は、本サービスを本規約に従って利用する権利を許諾するものであり、これらの権利を移転するものではありません。本アプリが利用しているオープンソースソフトウェアのライセンスは、アプリ内の「このアプリについて」から確認できます。
当方は、本サービスが利用者の特定の目的に適合すること、期待する結果を得られること、および中断・エラーなく提供されることを保証しません。
当方が本サービスに関して負う損害賠償責任は、当方に故意または重大な過失がある場合を除き、利用者が直近12か月間に本サービスに対して支払った金額を上限とします。無料でご利用の場合は、当方は責任を負いません。
ただし、本規約が消費者契約に該当する場合において、消費者契約法その他の法令により無効となる免責は適用されません。この場合であっても、当方は通常生じうる損害の範囲を超えて責任を負わないものとします。
本サービスにおける情報の取扱いは、プライバシーポリシーに定めるとおりです。プライバシーポリシーは本規約の一部を構成します。
当方は本規約を変更することがあります。変更する場合は、変更後の内容と版数・発効日を本ページに掲示します。重要な変更を行う場合は、アプリ内でもお知らせします。発効日以降に本サービスを利用された場合、変更後の規約に同意いただいたものとします。
本規約は日本法に準拠します。本サービスに関して当方と利用者との間に生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Octa Share is provided by Octa Air LLC (合同会社Octa Air). Contact: support@octa-air.co.jp. Using the app or opening a share link means you accept these terms. Features that send user-created content to another user remain unavailable until you explicitly review and accept the current version in the screen described in section 6.1.
Octa Share shares your current location for a limited time with the people you hand a link — and, unless you turn it off, a PIN — so they can find you. It also offers a meetup pin, a Bluetooth "are they nearby" reading, and coarse sharing at country / prefecture / municipality level. It is not a monitoring or tracking service: every share carries an expiry and stops on its own.
Octa Share is not intended for children under 13. If you are a minor, use it — and buy anything in it — only with the consent of a parent or guardian.
An anonymous account is created on first launch; no name or email is required. On Android only, linking a Google account is optional and exists so your friend list survives a reinstall. The iOS app offers no third-party sign-in. You are responsible for your device: whoever holds it can act as you.
You decide who receives a share link, and we cannot stop a recipient from forwarding it. A share created without a PIN is readable by anyone holding the link alone. Do not collect, share or publish someone else's location without their consent. You can stop any share at any time, after which nobody can see it.
Do not use Octa Share to stalk, follow or monitor anyone without their consent; to break the law; to send a sexual, hateful, threatening, harassing, fraudulent, impersonating, privacy-invasive or otherwise harmful display name or share label; to impersonate someone or obtain another person's link or PIN; to place abnormal load on our servers or automate requests; to circumvent limits or paid features; to reverse-engineer, decompile or modify the app or connect with a modified client; or to resell or redistribute the service without our written permission. We may suspend an account or delete a share that does any of these, without prior notice.
The initial public release provides every feature free of charge and has no purchase screen or in-app purchase. The following terms apply only if we offer Octa Share Pro in a future release. The free scope, limits and prices shown on that release's purchase screen will be authoritative. Purchases go through the App Store or Google Play, which handle payment, refunds and payment methods — we never receive your card details. Period-based plans are auto-renewing subscriptions: unless you cancel at least 24 hours before the period ends, they renew for the same period and your store account is charged again. Where a free trial is offered, its length is stated on the purchase screen, and cancelling more than 24 hours before it ends costs nothing. Cancel from your subscription settings in the App Store or Google Play at any time — deleting the app does not cancel a subscription — and Pro features remain available until the period you paid for runs out. A one-time (lifetime) purchase, where offered, does not renew. Refunds follow each store's rules; we cannot issue them directly. If prices or contents change, we will announce it in the app or through the store beforehand, and existing subscriptions follow each store's own procedure.
Apple's terms (including its end-user licence provisions) also apply to copies obtained from the App Store, and Google Play's terms to copies obtained from Google Play. These terms are an agreement between you and us: Apple and Google do not provide the service and are not responsible for it or for support. Where these terms conflict with a store's terms, the store's requirements prevail.
Positions come from your device's sensors and can be inaccurate or unavailable indoors, underground or in the mountains. Locations and altitudes are indications, not guarantees. Do not rely on Octa Share for emergencies or anything life-critical — network failures, a flat battery or the OS suspending the app can all stop updates. Bluetooth proximity readings are heavily affected by the radio environment. We do not guarantee uninterrupted availability, free or paid.
We may change the service, or suspend it temporarily for maintenance or incidents. If we discontinue it in whole or in part, we will give notice in the app or on the web where we can. Unexpired paid periods are then handled under each store's rules.
All rights in the app and the service belong to us or our licensors. These terms grant you the right to use the service under them, nothing more. Open-source licences used by the app are listed under "About" in the app.
We do not warrant that the service fits a particular purpose, produces a particular result, or runs without interruption or error. Except in cases of our wilful misconduct or gross negligence, our total liability is limited to what you paid us in the preceding 12 months; where you use the service for free, we accept no liability. Nothing here excludes liability that Japan's Consumer Contract Act or other applicable law does not permit to be excluded; even then, our liability does not extend beyond ordinarily foreseeable damages.
How we handle information is set out in the Privacy Policy, which forms part of these terms.
We may revise these terms. A revision is published on this page with a new version number and effective date, and significant changes are announced in the app. Using the service after the effective date means you accept the revised terms.
These terms are governed by Japanese law. The Tokyo District Court has exclusive jurisdiction of first instance over any dispute arising from the service.
